TERMS OF USE

These Terms of Use (including all other terms, policies, notices, guidelines, and forms referenced herein or otherwise available on the Platform or by hyperlink) (“Terms”) govern your use of the websites and Web Applications provided by Bean Search Expert Sdn. Bhd. (hereinafter referred to as “Pickup Now”, “we”, “us”, or “our”) (collectively, the “Platform”).

The “Services” we provide or make available include:

  1. the Platform, and
  2. the services provided by the Platform and/or by Pickup Now and made available through the Platform.

Any new features added to the Services are also subject to these Terms.

By accessing or using the Platform, you acknowledge that you have read, understood, and agreed to these Terms and consent to the processing of your personal data in accordance with our Privacy Policy. If you do not agree with these Terms, you must immediately discontinue the use of the Platform and Services.

The Platform may be used by:

  1. natural persons who have reached 18 years of age; and

  2. corporate legal entities (e.g., companies).

Users under the age of 18 must obtain consent from their parent(s) or legal guardian(s), who, by accepting these Terms, agree to take full responsibility for the user’s actions, activities, and any charges incurred. If you do not have such consent, you must stop using or accessing the Platform immediately.

Pickup Now reserves the right to amend, modify, or update these Terms (including our policies) at any time without prior notice. You are encouraged to review these Terms regularly. Continued use of the Platform constitutes your acceptance of the revised Terms.

Depending on which Platform you access and use, these Terms form the contract between you and the following Pickup Now entity:

Through our Platform, Pickup Now connects you with vendors (“Vendors”) from whom you can order a variety of goods, including prepared meals, non-prepared food, and other non-food items (collectively, the “Goods”).

When you place an order (“Order”), Pickup Now acts as an agent on behalf of the Vendor to facilitate, process, and conclude the Order, and subsequently for either us or the Vendor to deliver your Order. Vendors may be owned and operated by third-party vendors, our affiliate companies, or us.

4. Use of the Platform and Pickup Now Account

4.1 Registration

To use the Platform, you must register for a Pickup Now account and provide accurate personal information including your name, valid email address, mobile number, and a secure password. You are solely responsible for maintaining the confidentiality of your login credentials and all activities conducted under your account.

4.2 Account Responsibility

You agree that all Orders placed under your Pickup Now account are your sole responsibility. Pickup Now shall not be liable for issues arising from incomplete or incorrect information provided by you.

4.3 Account Suspension, Restriction, or Termination

Pickup Now reserves the right, at its sole discretion, to suspend, restrict, or terminate your account without prior notice if we detect or reasonably believe that your account is associated with:

  • Unusual, suspicious, or fraudulent activity;

  • Scams, deceptive or illegal behavior;

  • Multiple user complaints or verified misconduct;

  • Violation of these Terms or any applicable laws;

  • Misuse of promotional offers, vouchers, or fraudulent payment activities.

We may also conduct investigations or request additional verification to confirm your identity or account activities. Failure to comply may result in suspension or termination. Pickup Now shall not be liable for any loss, damages, or claims resulting from any such actions.

4.4 Account Deletion

If you wish to delete your Pickup Now account, please contact us via email. Account deletion requests will be processed in accordance with our Privacy Policy.

5. Restrictions and Prohibited Activities

The following activities are strictly prohibited on the Platform. Users who engage in these may face suspension, termination, and/or legal action:

  • Violating any applicable laws or regulations;

  • Posting content that infringes intellectual property, privacy, or publicity rights;

  • Posting defamatory, obscene, or offensive content;

  • Engaging in cyberbullying or harassment;

  • Posting spam or misleading information;

  • Impersonating another person;

  • Engaging in fraudulent transactions or misrepresentation;

  • Collecting data or personal information from other users without consent;

  • Encouraging others to engage in prohibited behavior.

Pickup Now reserves the right to investigate and remove any content, suspend users, and report violations to authorities if deemed necessary.

6. Orders

When you place an Order through the Platform, Pickup Now confirms it via a confirmation email or in-app notification. Orders may be subject to vendor availability, minimum order value, or special instructions. Refunds and cancellations will be handled in accordance with Pickup Now’s refund policy.

Pickup Now reserves the right to cancel any Order or suspend your account if fraudulent or suspicious activity is detected.

7. Prices and Payments

Prices displayed on the Platform are inclusive of applicable taxes unless otherwise stated. Pickup Now reserves the right to modify prices, payment methods, or additional fees (such as service or delivery fees) at any time.

Accepted payment methods include Visa, Mastercard, FPX, and other methods available on the Platform. Pickup Now does not store your payment information directly; payments are processed through secure third-party providers.

8. Pick-Up and Delivery

Depending on Vendor options, you may choose Pick-Up or Delivery. Pickup Now shall not be held responsible for delays, quality issues, or incomplete Orders arising from Vendor Delivery. You are responsible for inspecting your Order upon receipt.

9. Vouchers, Gift Cards, and Promotions

Vouchers and promotional offers are subject to specific terms, validity periods, and redemption limits. Pickup Now reserves the right to modify, suspend, or revoke vouchers or promotions at any time in cases of misuse, fraud, or system abuse.

10. Representations, Warranties, and Limitations of Liability

The Platform and Services are provided “as is” and “as available”. Pickup Now does not guarantee uninterrupted access, freedom from errors, or the accuracy of information provided by Vendors.

Pickup Now shall not be liable for any indirect, incidental, or consequential damages, including loss of profits, data, or goodwill. Your sole remedy for dissatisfaction is to stop using the Platform.

11. Vendor Responsibility

Vendors are responsible for the preparation, condition, and delivery of Goods. Pickup Now is not liable for any issues related to quality, safety, or delays caused by Vendors.

12. Personal Data Protection

You consent to Pickup Now collecting, processing, and storing your personal data in accordance with our Privacy Policy.

13. Indemnity

You agree to indemnify and hold harmless Pickup Now, its directors, officers, employees, and affiliates from any claims or damages arising from your use of the Platform or your breach of these Terms.

14. Third-Party Links

The Platform may contain links to external websites. Pickup Now is not responsible for the content or privacy practices of such third-party sites.

15. Termination

Pickup Now reserves the right to terminate or suspend your account and access to the Platform at any time, without prior notice, for violations of these Terms or any unlawful activities.

16. Amendments

Pickup Now may amend these Terms at any time. The revised Terms shall be effective immediately upon posting on the Platform. Continued use constitutes acceptance.

17. Severability

If any provision of these Terms is found invalid, the remaining provisions shall remain in full force and effect.

18. Governing Law

These Terms are governed by the laws of Malaysia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Malaysia.
